Government User Agreement for QCTS – A Web-Based Tool

Please read the following User Agreement carefully before using the Quick Compliance Tool Suite (QCTS). By using this tool, you agree to be bound by this User Agreement.

The Quick Compliance Tool Suite(QCTS) is provided to you by the Commander Navy Fleet Industrial Supply Centers(COMFISCS). COMFISCS is an instrumentality of the United States Government, and provides this tool without warranty or guarantee, either express or implied.  QCTS is provided as is with attendant disclaimers with respect to any liability.  COMFISCS and the Department of the Navy assume no responsibility for fitness for purpose and/or merchantability in accordance with the waivers set forth above.  The User fully understands and agrees to the following:

  • Any modification to or selling of QCTS is strictly prohibited.
  • The User shall not use the name of QCTS or COMFISCS on any advertisement, product, or service that is directly or indirectly related to QCTS or associated documentation without the prior written approval of COMFISCS.
  • The User shall not alter, damage, or destroy QCTS; use this service to conduct or attempt to conduct any business or activity or solicit the performance of any activity other than that associated with its Government mission; or take any action that results in blocking access to this website by other users.
  • The User shall not further distribute the software to any entity without the express permission of COMFISC and subject to the conditions set forth in the following paragraph.

Further, by accepting this Agreement, the User:

  • Shall maintain control of and record all distributions of QCTS software to third parties.
  • Shall ONLY allow access to third parties via a written contract clause and with an express requirement for the contractor to use the software only in furtherance of contract requirements. 
  • Shall require all third parties to return all copies of the software, access codes, and related written documentation upon contract execution or termination, whichever occurs first.  Third parties shall have no greater rights in the software than those rights established in this Agreement, to include the agreement to allow monitoring, see "bullet" below.
  • Shall expressly consent to software monitoring by COMFISCS, Department of the Navy, or support contractor with the appropriate organizational conflicts of interest (COI) agreements in place at all times.
  • Shall protect the software from any virus or like infections.
  • Shall be wholly responsible for the selection, acquisition, operation, and maintenance of all equipment and software, including the Internet access software (browser) necessary for this access, and for all costs, expenses, and payments associated with such access.
  • Shall accept responsibility for any actions taken using his/her assigned logon ID.
  • Shall follow all established information technology security practices, to include, but not limited to, logon ID protection and system security maintenance.
  • Shall notify COMFISCS of any decision to terminate access to any of the QCTS applications at least ten (10) calendar days prior to actual termination of said access.
  • Shall return all software and related documentation, including access codes, to COMFISC upon demand or when its use is no longer required, whichever occurs first.
  • Shall make no copies of this software or documentation except as a back-up copy in the event of corruption, infection, or like contamination of software.

This Agreement supersedes any prior agreements with respect to the same subject matter. COMFISCS may revise this Agreement at any time, and such revision shall be effective immediately following the posting of such revision to the QCTS web site. The User's continued access to and use of these services following any such revision shall be deemed acceptance of the revision(s). If any portion of the Agreement is deemed invalid or unenforceable, the remaining portions will continue in full force and effect. This Agreement is entered into between COMFISCS and the User and the User may not assign rights or obligations specified by this Agreement to another person. Any violation of the terms or conditions of this Agreement by the User may result in monetary, civil, and/or criminal penalties.

By accepting this Agreement, the User warrants that he/she has read and understands the terms and conditions specified herein and agrees to be bound by them.

User likewise understands that any disputes that arise under this Agreement shall be subject to adjudication by the Commanding Officer, COMFISC, without resort to any other appeal or review.  The decision of the Commanding Officer shall be final and binding on all Users.
